What the New Regulation Means for Multi-Unit Operators
Effective July 1, 2026, California requires restaurant groups covered by federal menu labeling rules (20+ locations) to provide written notification of the 9 major allergens contained in each menu item—either on the menu/menu board or digitally (incl. QR). If digital is used, you must also provide an alternative written method (e.g., allergen menu, chart, grid, booklet). Sesame is also now classified as a major allergen that must be labelled. While you can manually make updates, we strongly encourage a digital solution.

Who must comply?
Chains subject to 21 U.S.C. §343(q)(5)(H) (generally 20+ locations operating under the same name with substantially the same menu items). If any locations are in California, those CA venues must comply.
Where must allergen disclosures appear?
Either on the menu/menu board (statement below or immediately adjacent to the item), or in a digital format (incl. QR). If you use digital, you must also provide an alternative written method (e.g., allergen menu, chart, grid, booklet, or other written materials).
Which allergens are covered?
The 9 majors: milk, eggs, fish, crustacean shellfish, tree nuts, wheat, peanuts, soybeans, sesame, plus proteins derived from them.
Does SB-68 add new training rules?
No. It relies on existing CA Retail Food Code knowledge/training requirements; Foodini supports staff guidance and playbooks.
How do we prove compliance to inspectors?
Maintain visible statements on menus/digital and keep exported audit packs. Local agencies may perform visual verification or other reasonable verification methods.
Are any operations exempt?
Yes: compact mobile food operations and nonpermanent food facilities are exempt from these disclosure provisions. Prepackaged foods with federal allergen labels are outside this section.
